General Terms and Conditions of Booking

Please review the following conditions of the unit you will be renting. By accepting your confirmation and checking into the unit it is understood by all parties that you have reviewed and accepted the terms herein.

Rental Agreement:

ARRIVAL AND DEPARTURE: Upon confirmation of your reservation, you will receive emails with directions to the unit and the keyless entry code, which is necessary to access the unit (or instructions for accessing unit). Using this code, you may check into the unit anytime AFTER 3:00 PM on your date of arrival. Checkout is NO LATER than 11:00 AM. Early check-ins and late checkouts are admissible only by previous agreement. It is the guests’ responsibility to print, save, or otherwise note their access code before arrival. HCRL LLC will not issue any refunds as a result of failure to do so.

MAXIMUM OCCUPANCY: The property is intended for the exclusive use of registered guests (i.e., families, retreats, reunions) and is not to be used to host parties or events that include additional unpaid guests. See reservation page for each property for maximum occupancy. Temporary visits by unpaid guests are limited to a maximum number of people which may vary by property capacity. Please request information specific to your rental if you have any questions.

If it becomes known to us after your check-in that you have additional unclaimed guests staying in the home, we may assess a fee per guest, per stay, in addition to the normal nightly rate for these guests.

DATE CHANGES: Guests may request to change the dates of their reservation free of charge, provided the dates they request are available. Reservations made at special or last-minute rates may be subject to a surcharge should the special conditions under which their original reservation was made no longer apply.

CLEANING FEES: Cleaning fees, if applicable, are assessed on a per-stay basis and cover the costs of preparing the home for your stay. This includes the provision of fresh towels, linens, a starter set of paper products (i.e. toilet paper and paper towels), coffee, tea, creamer, sugar, and toiletries (where applicable). Guests should feel free to enjoy the house and to leave soiled linens and towels for the housekeeper to launder. However, we ask that guests please dispose of their trash in the provided bins upon checkout. Leaving the unit in an excessive state of dirtiness may result in an additional cleaning surcharge.

VACATION RENTAL DAMAGES: Guests authorize management to process charges for the costs of repair or replacement of damaged or missing items beyond normal use, excessive clean up, stains, odor removal, late check out, or additional cleaning crew costs. Any damages to rental property should be communicated by the guest to management after arrival, and are expected to be covered by the guest via credit card on file.

NO DAILY HOUSEKEEPING SERVICE: Daily maid service is not included in the rental rate. However, it may be available at an additional cost. Please inquire by emailing office@truealaska.org.

NO MEAL SERVICE: Some units are equipped with kitchen facilities and you may use them to self-cater. This property is not located near delivery services and the nearest grocery stores for purchasing food items is approximately 40 miles away. Please plan accordingly.

PARKING: Free parking is limited to two (2) vehicles per booking. Vehicles are to be parked in designated parking areas only. Any illegally parked vehicles are subject to towing; applicable fines/towing fees are the sole responsibility of the vehicle owner.

HOT TUB/SAUNAS (when applicable): No children under the age of 6 years are permitted in any available hot tubs or saunas at any time. When using these, please remember there is a certain health risk associated with this facility. Use at your own risk. PLEASE DO NOT STAND ON HOT TUB COVERS. These covers are for insulation purposes and are not designed to support the weight of a person or persons. To conserve energy and ensure the hot tub stays warm, please remember to cover it when not in use.

WATER AND SEPTIC: We ask that guests are mindful of water usage and respectfully ask that they DO NOT FLUSH anything other than toilet paper. Feminine hygiene products such as tampons and pads should NOT be flushed at any time.

NO SMOKING: All properties are NON SMOKING and guests are not permitted to smoke anywhere inside the home at any time. Smoking is only allowed outside of any fenced areas of the property. We request that you properly dispose of cigarette butts in trash receptacle. Do not leave any cigarette butts on the property.

Smoking in the house will result in a damage penalty of $200, plus the cost for reparation or replacement of any items in the home burned or damaged as a result.

NO DRUGS/ALCOHOL: All properties are drug-free and alcohol-free. Drugs of any kind (including marijuana) or alcohol will not be permitted on the property at any time.

PETS: Due to other guests who may have allergies or sensitivities to animals, pets are not permitted inside rental units. If you have a pet with you, it should be kept in an outdoor kennel or on a leash and should not be taken into the living areas of the rental unit. Our expectation is that you will clean up after your pet in any outdoor common areas.

SEVERE WEATHER OR STORM POLICY: All properties have the possibility for times of bad weather. In case of any severe storm, whether snow, rain, hurricane, or tornado, no refunds will be issued unless the state or local authorities issue a mandatory evacuation order for the area.

On the day that a mandatory evacuation order in the Storm Warning area is issued, we will immediately refund:

  • Any unused portion of rent from a guest currently staying.

  • Any advance rents collected or deposited for a reservation that is scheduled to arrive during the "Storm Warning" period.

TRAVEL INSURANCE: We do not provide insurance for your trip, but you have options available. If you wish to purchase travel insurance, we recommend that you visit other sites such as www.insuremytrip.com for details and to purchase.

LOST AND FOUND: We will make every effort to locate any possessions left behind. Please email us if you have lost any items. If found, we will email you requesting the shipping address and will ship the items back to you for the cost of the packaging and shipping, which will be charged to your credit card on file, plus an additional 4% credit card processing fee. Any items found in homes will be kept for 14 days. If items are not claimed at the end of 14 days, they will be donated to charity.

RIGHT TO REFUSAL OF SERVICE: Both management and the homeowners reserve the right to refuse service if guests have not claimed the proper number of guests staying, or if either party has adequate reason to believe that the property or content thereof will be put at unnecessary risk during a guest's stay for reasons such as, but not limited to, the use of illicit substances on the premises, unauthorized gatherings, excessively loud and disrespectful behavior, or reservation obtained under false pretense.

WRITTEN EXCEPTIONS: Any exceptions to the above-mentioned policies must be approved in writing in advance of the date of the guest arrival.

Disclaimer:

These units are privately owned. The owners are not responsible for any accidents, injuries, or illnesses that occur while on the premises or its facilities, nor are they responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests expressly assume the risk of any harm arising from their use of the premises or others whom they invite to use the premises. Premises are monitored by a 24-hr video surveillance recording system. Vandalism or damage to the unit(s) may result in prosecution.

Waiver and Release of Liability

This agreement releases Historic Chulitna River Lodge LLC ("HCRL") and/or Anna Holdings LLC ("AH") business entities, and the owners or employees in their employment capacities and as individuals, from all liability relating to any loss or injuries that may occur during any outdoor activities on and off the body(ies) of water located at Historic Chulitna River Lodge, North Parks Highway, Alaska.

By digitally signing/accepting this agreement, I agree to hold harmless HCRL and/or AH and all individuals representing such entities entirely free from any liability, including financial responsibility, for injuries incurred, regardless of whether injuries are caused by negligence.

  1. I acknowledge and agree that this clause waiving and releasing claims of negligence against HCRL, AH, and related parties is beyond the legal application of the inherent risk and assumption of risk provided herein, and that I am specifically WAIVING ALL NEGLIGENCE CLAIMS that I might have against HCRL, AH, or the related parties.

  2. This release and hold harmless agreement includes all claims, in law or in equity, mature or to mature in the future, known or unknown, related to outdoor activities and/or rental equipment including, but not limited to, loss of life, bodily injury, property damage, or economic loss. I recognize that I may be liable for any damage or destruction to any rental equipment, notwithstanding my waiver herein. I expressly agree to indemnify, hold harmless, and to defend HCRL and AH as well as their related employees, owners, or representatives, against any suits, actions, claims, damages, liabilities, or expenses related in any way out of my use of rental equipment or engagement in outdoor activities.

  3. I agree that my sole remedy against HCRL, AH, or any of the related parties might be the return of the rental fee, but that decision shall rest in the sole discretion of HCRL.”

I also acknowledge the inherent risks involved in outdoor activities (especially those risks associated with bodies of water), including but not limited to rental and use of kayaks, canoes, and/or boats, and all other applicable outdoor activities. These risks include, but are not limited to, bodily injuries, physical harm, mental stress, and/or anxiety, or death. I swear or affirm that I am participating voluntarily, and that all risks have been made clear to me. Additionally, I do not have any limitations or conditions, medical or otherwise, that will increase my likelihood of experiencing injuries while engaging in this activity.

  1. I am ultimately responsible for my own safety and for the safety of those around me while engaged in outdoor activities or use of rental equipment. I understand and expressly acknowledge that I have a responsibility to act in a safe manner at all times and to comply with all laws, ordinances, regulations, and rules relating to health, safety, noise, environmental protection, and waste disposal. I enter into these activities at my own risk.

  2. I agree and acknowledge that all rental equipment is being rented “AS-IS,” with all faults, and without any warranty or representation by HCRL or AH or any related parties as to the condition, operation, or function of the rental equipment. It is my responsibility to alert HCRL if there are any issues or defects with any of the rental equipment before my use of that equipment or immediately upon discovery of the same. I had ample opportunity to inspect the equipment prior to use.

  3. I specifically release any right I may now or hereafter have to reform, rescind, modify, or set aside these provisions based on mutual or unilateral mistake or otherwise. The risk of such uncertainty and mistake is assumed by me in exchange for use of the rental equipment and/or engagement in outdoor activities.

  4. I further acknowledge that I may bring my own personal property to the premises, but that I do so at my own risk and HCRL and AH are not responsible for any lost, stolen, or destroyed items.

By my acceptance of this waiver, I forfeit all rights to bring a suit against HCRL and/or AH and all individuals representing such entities for any reason. In return, I will receive participation in the outdoor activities of my choice. I will also make every effort to obey safety precautions as listed in writing and/or as explained to me verbally. I will ask for clarification when needed. If I fail to ask for clarification, I affirm that instructions are clear to me as presented.
